Position Details

As per ATIPPA, 2015, the commissioner shall hold office for 6 years from the date of appointment. The
office will be filled by the Lieutenant-Governor in Council on a resolution of the House of Assembly.

Office of the Information and Privacy Commissioner (oipc.nl.ca)

The Information and Privacy Commissioner is an independent non-partisan Officer of the House of Assembly. The Commissioner is responsible for promoting and ensuring public access to information from provincial public bodies, and the protection of privacy. These statutory duties are mandated under the Access to Information and Protection of Privacy Act, 2015 and the Personal Health Information Act.

Reporting to the House of Assembly through the Speaker, the Commissioner provides strategic leadership and oversight to a team of analysts who develop and deliver programs to inform and educate people and public bodies of their rights and responsibilities with respect to information access and privacy. The Office also advises on information and privacy developments, and procedures and practices. As well, the Office conducts compliance investigations, monitors and audits access and privacy practices and procedures of public bodies, and reviews authorizations for the collection of personal information.

The Commissioner is responsible for resource management, including the financial, human resource, and administrative functions in accordance with the policies and procedures of the Management Commission, the House of Assembly Accountability, Integrity and Administration Act, and other applicable legislation. The Commissioner is solely responsible for the advisory, educational, investigatory and reporting functions of the Office as established under legislation. The Commissioner exercises the responsibilities and conducts duties in accordance with the Code of Conduct for employees and statutory officers of the House of Assembly.

Screening Criteria

Applicants are required to demonstrate progressively responsible experience in the areas of management and leadership. Qualifications would normally be acquired through completion of a university degree in a relevant discipline combined with relevant experience. Equivalencies will be considered.

Assessment Criteria

This position requires the application of sound judgment to make impartial decisions on complex issues while balancing multiple, and often competing, interests. The ability to effectively exchange information is essential. Knowledge of access and privacy legislation, principles and emerging best practices, as well as the ability to collaborate with stakeholders are critical to the role. Resource management skills are required to plan and coordinate resources to deliver the legislated mandate in accordance with defined timeframes. Demonstrated mediation and adjudication skills, and an understanding of legal principles and practices is required.
